I suffered construction damage. Can I sue?

Last updated on: May 22, 2020
Property adjacent to my mobile home is being graded and they have been using blasting pretty extensively. The blasting cracked the joints in my cvpvc in my bathroom and rotted the whole thing out. They have been evasive and non-responsive to my requests for their insurance carrier. I paid $5000 in repairs for the bathroom. They refuse to pay me. What do I do?

First, it's crucial to document the damage thoroughly. Make sure you take clear photos and videos of the affected areas in your mobile home. Also, keep a detailed record of when the blasting occurred. Regarding the repairs, ensure you have all the receipts and invoices related to the $5,000 you spent – these are key pieces of evidence. It's also important to record all your communications with the property owner responsible for the blasting. That would strengthen your case if you can get statements from neighbors or others who witnessed the blasting and its effects. I strongly recommend reaching out to a local attorney who specializes in property damage or tort law for personalized guidance. They'll be able to take into account the details of your situation and the relevant laws in your area and guide you on the best course of action which might include filing a lawsuit for property damage or mediation as a less aggressive approach. In the meantime, you should also check with your insurance to see if such damages are covered under your policy. If you do manage to get the insurance details of the other party, filing a direct claim with their insurer could be a viable option.
