Person in control of a vehicle as defined by the California Vehicle Code

My vehicle was towed under 22651(h) CVC but I was not driving it, not sitting in the driver's seat (nor was anyone else), I was not inside the vehicle and the engine was not running. I was outside of the vehicle when contacted but entered the trunk and back seat of the vehicle to obtain identification, at the officer's request, and clothing during the contact.
