While the name might sound lofty, the ruleâs goal is simple: to ensure that the original evidence speaks for itself when a writing, recording, or photograph is in question. What Is the Best Evidence Rule? Under the Texas Rules of Evidence (Rule 1002), the Best Evidence Rule requires that when a party seeks to prove the contents of a writing, recording, or photograph, the original is generally required. In other words, if the issue in dispute is what a document says â such as the terms of a contract, the text of a letter, or the contents of a video â you must produce the original (or a legally acceptable substitute). This prevents errors, fraud, and misrepresentation that might occur if a party relies solely on memory or a questionable copy. When Does the Rule Apply? The Best Evidence Rule only applies when the contents themselves are at issue â that is, when the writing, recording, or photograph is the evidence. Examples include: ⢠The specific language of a contract, email, or text message. ⢠The terms of a will or trust document. ⢠The content of a video, audio recording, or photograph. It does not apply when the existence of a document is being proven (for example, showing that a contract existed without proving its exact terms) or when the documentâs content is merely collateral to the issue. Still, plaintiffs face challenges: jurors must be persuaded that the server could actually tell the patron was dangerously drunk at the moment of service, not merely that the person later caused an accident. Bars, meanwhile, should keep comprehensive training records, surveillance footage, and service policies to demonstrate compliance and potentially invoke Safe Harbor protection.
