 Austin divorce attorneys want their clients to understand that you must reside in the state where you file for divorce. You are not permitted to examine each state's divorce laws and then select the state that you believe is most likely to provide you with a favorable settlement. Your spouse, on the other hand, does not have to be a resident of the state in which you file for divorce. If you moved to Texas after separating from your spouse, you could file for divorce after establishing residency even if your spouse still lives in another state.

The time it takes to establish residency varies greatly from state to state. To make matters even more complicated, some states require a spouse to be domiciled in the state in order to file. Domicile is a more difficult standard to establish than residency. Domicile necessitates a permanent residence in which you intend to reside. The only requirement for residency is that you be physically present in a specific location.

A person can technically have multiple addresses. A person, however, can only have one domicile. Someone who travels frequently for business and owns a vacation home, for example, may be a resident of Texas, Florida, Arizona, or Indiana. However, if his mail is delivered to his permanent address in Texas, where he votes and has his driver's license, only Texas will be considered his domicile.

 If you have children with your spouse, you should be aware that unless your divorce decree states otherwise, the child's home state will have custody jurisdiction.
