Immigration Law Q--Which a Quit Claim Deed or Pwr of Atty would give best freedom/right to dispense property if Illegal Immigrant Husband is deported in MN to Mexico?
Facts-Husband (H) and Wife(W) married; H is illegal immigrant from Mexico--workplace investigated and a list of illegal was found; We are interested in wife's ability to dispose property if H is no longer in country i.e. deported. There are two possibilities it seems here: 1. Quit Claim Deed 2. Power of Atty. This is a Minnesota Situation. I need to figure out which form would give best freedom/right to dispense property if necessary and which offers the broader authority for independent action. What procedures are required to give it legal effect i.e. registers with city or property division? If so, what is required by that entity i.e. cost of registration, time constraints, and formatting requirements? I found Minn Stat 507.06 relates to Quit Claim Deeds and 507.02 relates to Power of Atty. If this marriage is not legal, how does that effect this/what's the solution?
