Contractual Attorney's Fee Provision May Allow for Recovery of Attorney's Fees on Non-contract Claim
The parties had entered a contract with contained attorney's fees clause broadly allowing recovery of attorney's fees to the prevailing party in an action. Plaintiff sued for breach of contract and related negligence, but prevailed only on negligence claim. California Court held: under the broad language of the attorney's fees clause, plaintiff may recover her attorney's fees.
